Uzbek refugee arrested in Chicago, charged with terrorism support

A refugee from Uzbekistan has been arrested in Chicago and charged with providing support to a suspected Islamic terrorist group that U.S. authorities say is seeking to overthrow the secular government of his Central Asian home country.

Jasmshid Muhtorov, 35, who resides in Colorado, was taken into custody on Saturday at Chicago's O'Hare International Airport by FBI agents and made his initial court appearance in federal court on Monday, the U.S. Justice Department said.

A criminal complaint charging him with providing and attempting to provide material support to a designated foreign terrorist organization was unsealed on Monday in federal court in Denver.

Court documents filed in the case said Muhtorov indicated that he planned to travel overseas to fight on behalf of the Islamic Jihad Union, a Pakistan-based extremist group that opposes secular rule in Uzbekistan and seeks to replace the current regime there with a government based on Islamic law.

Federal prosecutors said his arrest, capping a "long-term investigation," highlights "the continued interest of extremists residing in the United States to join and support overseas terrorists."

If convicted of the charge against him, Muhtorov faces up to 15 years in prison.

If you read the article, the guy was a refugee. And he was planning on going back overseas to fight for a group that stands against the government of Uzbekistan. Not the US.

Honestly, I fail to see how this is even our issue. If we're worried that he'll later take up arms against us, then go ahead and deport him, send him to a different country. Since he's not planning to fight against the US, why incarcerate him here on taxpayer dollars?

Unless, of course, this is the NDAA FY2012 being enacted; in which case he'll be 'detained indefintely without charge or trial' for any acts of agression against the US or any of its allies--again, on taxpayer dollars. Do we have a trade agreement with Uzbekistan? This would make more sense if we have trade agreements and extradition agreements with Uzbekistan and they were officially an 'ally'.

        According to travel (dot) state (dot) gov:

          Chances are he came in last year before the NDAA was enacted. In case you hadn't heard about it, the NDAA gives the US military authority to detain anyone, American citizen or not, on home soil or off, without being charged with a crime, without a trial, indefinitely until the 'war on terror' is over if you're caught engaging in or advocating resistance to the US or any of its allies. Chinese dissidents had better be careful about coming over here and speaking on public record--under this rule the US can jail them indefinitely for hostilities against the Chinese government.

          And keep an eye on the passage of HR3166--currently making its way throught he House, it'll strip you of your citizenship if you have dual citizenship, have ever worked in a foreign government office, or even if you're caught speaking/creating/printing/disseminating any literature that incites or advocates rebellion against the US or any of its allies.

          You know, some type of border sealing solution might help as it's a true filter - works in both directions if need be but therein lies the potential trap. Still I was a guy that thought we should build a wall out of the junk cars (from a few years ago) 12' high and 5' underground. Wire it, cameras, vibration sensors, lights and you have two things: a place for all those cars and big security that works day and night. BTW, the process involves a super welder I saw in Popular Mechanics and some spray on chemical goo that turns almost pretty. No paint, lasts for a LONG time. The idea is STILL not a bad one!

          Keeping the bad guys out won't work well if they're already here. Just a thought here but I for one believe that our government HAS pretty much staked out many of the potential denizens of the Muslim world that reside here. I would also suspect that they watch them as best they can, who they associate with, when, where, why and how. The border filter is a day late and a dollar short.

                        Anyone who's astonished that terrorists are still entering our country has obviously never had any dealings with an arm of our government or they'd have a better understanding of how inept and ineffective they are. It's such a nice warm feeling to know that our retirement, security and now healthcare are all in the hands of the federal government and let's not even talk about the financial markets. Prepare to be amazed, and better begin arming yourselves because with the newest cuts in our military budget, it wouldn't surprise me to learn that the government has determined that better use of our armed forces would be to help clean up the federal parks...maybe we'll get lucky and they'll find a few terrorists.

                        Is it no small surprise that Rahm Emanuel recently met with the President and suggested that the best course for his re-election campaign would be to talk about anything other than his record...pathetic.

                                    Fundamentally, it's still America and we're subject to the interpretations of our laws wielded by high powered lawyers and bogus courts. I mean our best ideas are turned against us - the Constitution being one such tome that comes to mind.

                                    Very simply, times have changed. Why not get two people, elected BY the people and regardless of partisanship or lack thereof from every state to study what IS vs what WAS. How is it NOT working? How is it great and perfect? Then fix it.

                                    We hear everyday of the equivalent of the McDonald's lady and the boiling hot coffee; "I bought it here. I spilled it upon myself. I burn. YOU pay." You can apply it to so many situations. IS it right? I painfully broke a tooth at a Hardees from a steel chilli tie that made it to my chilli dog. Virtually the same sort of thing except that the woman KNEW the coffee was hot - I did not know the chilli ring was in my dog. Cut to the chase: she got a few million dollars. I got zilch and I just wanted my tooth fixed.

                                    The fact that these two cases can be presented on the same page tells me "something's wrong". It never gets fixed, however. WHY??

                                    We need to fix what's wrong. Our government is a dismal failure at "fixing" much of anything. It should be THEIR gig but it has not been for a very long time. We the people need WE the people, two or so from each state. They meet. They do things. ALL public, all the time. Live call in//internet "suggestion box". They don't legislate they actually DO something, all politics aside. Imagine what good could flow from such a design? And it's cheap!! Then send the solutions to the politicians and watch the fun.

                                    It's going to take something we don't yet have to fix ourselves, or we have it and just don't know it.

                                      A system like ours should work but does not. Why not repair it? We fix broken cars, homes, lives ... can't we fix a "system"? The problem is quickly seen: it supports and advertises itself for sustenance or, it's a parasite. Whatever it is, it's tough to get rid of as it's questionably intelligent and it does not want to go, not at all. IT reasons that it has to be here for everybody else to survive the day. IT thinks it deserves what it reaps and pillages from it's influence and power. NOT an easy bug to exterminate.

                                      Something new is needed and it's needed NOW.

                                        Plenty of people want to complain about 'the illegals' but few have concrete solutions for the problem. So here's mine, as a now-naturalized US Citizen, who came here legally (adopted by American Army vet) but spent time in the system as an 'illegal' when ICE lost my adoption paper:

                                        1. Refine the definition of 'illegal'. Illegal should mean those who hopped the border to do drugs and shot a cop on the way. No amnesty no matter how long ago the incident occurred. 'Illegal' should NOT mean those who came here legally but ICE took 16 years to process their applications. 'Illegal' should not mean those for whom ICE lost paperwork a decade after the fact. 'Illegal' should NOT mean those who were trafficked in as children, either through international adoption by crooked adoption agencies, by legal American citizen pedophiles for child sex, by their illegal parents, or are refugees. Yes, I am advocating amnesty--for anyone under 18 or who was under 18 at the time the offence was committed.

                                        2. Close the borders. Use the returning troops from the war to secure our northern and southern borders if necessary--since the NDAA got passed, Posse Comitatus has officially been cancelled--and anyway, National Guard and Coast Guard are no longer military, they're Homeland Security. Send out advance notice to the world a year in advance that we will be closing our borders. This will give everyone who wants to immigrate to the US time to get their applications in prior to the closure date. Stress to the world that we are NOT closing our borders forever, we are NOT going to become isolationists; we just need to get caught up on the paperwork backlog. Keep the borders closed for 2 years.

                                        3. Use the time the borders are closed to catch up on the enormous backlog of applications waiting to be processed. In 2010, ICE was just getting to applications filed by Mexicans in 1994, China in 2001.

                                        4. For those already in detention: prioritize the cases. Deport the truly 'illegal' first (see above definitions) then address cases for minor children, elderly/infirm, and terminally ill. Don't make those children wait for years in detention, it's inhumane. Offer them basic English language and civics classes while they are in detention so they will learn about our country; instead of penalizing them for their ignorance, offer them a chance to learn.

                                        5. If you have a case of someone who came here legally but ICE has not gotten to their paperwork and time expired (undocumented), release them on electronic monitoring once they have not been deemed a flight risk. This will ease the overcrowding in deportation camps and make room for more of the truly illegal, higher-priority cases--ICE's own stats say electronic monitoring has a 98% compliance rate--98&% of people released on electronic monitoring do show up in court for their immigration hearing. A 2009 Associated Press article said an examination of ICE records showed that ICE currently gets $1.7 billion to detain 33,000 people per year ($141 per night) and 18,000 of those people were simply undocumented and had not committed any crimes. Do the math:

                                        18,000 people x $141 per night x 365 day a year=$926,370,000

                                        Releasing those 18,000 undocumented, non-flight-risk elderly, terminally ill, and minor children on electronic monitoring would free up $926 million out of Homeland Security's $89 billion budget. That should be enough to hire more pencil pushers to get caught up on the backlogged paperwork and detain and deport more of the truly illegal in the 2 yr deadline above. Also add in the funds from the 'seized civil assets' the government takes from those who are detained and deported as illegal, that's a lot of money, definitely enough to get caught up on he paperwork backlog.

                                        6. Improve conditions for those in detention. I'm not saying they should have bingo night and TVs in every cell. I'm talking about adequate food; no meals with maggots, please give us eating utensils, and please give us clean underclothes and jumpsuits; NO ONE should have to wear underclothes still crusted by another woman’s period. And adequate medical care; if someone is having a seizure don't tell them to fill out form for an aspirin. If someone is on medication for something please allow them to continue taking those meds. Look up 'Victoria Arellano' for an example.

                                        7. Allow non-violent ICE detainees out on a day-labor program. You do it for nonviolent offenders, why should we be treated any different? Sitting for 24 hours a day in a deportation camp does no one any good whatsoever. The detainee has nothing to do but go crazy; let us out to work while we wait for the judge to throw us out.

                                        8. If the judge says they have proved they are a citizen RELEASE THEM. There is absolutely no excuse for keeping someone after a judge has ruled they should be released. Look up George Ibarra.

                                        9. If someone says they have proof that they are indeed a US citizen or a diplomat from another country, INVESTIGATE. The law of the US is 'innocent until proven guilty', not 'guilty until YOU prove you're innocent.' Don't automatically assume that because the person looks Latino or foreign that they MUST be here illegally. Look at Hans Keil of American Samoa.

                                        10. ACCOUNTABILTY. If one of us dies in ICE custody our legal US citizen relatives have a right to know if we have died! It won't matter to us, we're dead, but our relatives outside the deportation camp have a right to know we have died so they can claim our bodies and take care of us according to our respective beliefs. Even if you believe the 'illegal' doesn't have a right to Last Rites, not everyone believes so and if there are relatives willing to claim the body, they as legal citizens have the right to do so.
