U.S. Border Patrol agent Brian A. Terry was killed during a shootout with Mexican bandits south of Tucson, Ariz., in December 2010. Weapons seized afterward were later linked to Operation Fast and Furious, an ATF effort to trace the flow of weapons to Mexican drug cartels.
A long-awaited report on the U.S. government’s controversial gun-trafficking operation known as “Fast and Furious” released Wednesday found no evidence that Attorney General Eric Holder knew of the botched effort to trace the flow of guns to Mexico’s drug cartels prior to its public unraveling in January 2011.
The report by the Justice Department’s Inspector General Michael Horowitz said there is "no evidence that ... Holder was informed about Operation Fast and Furious, or learned about the tactics employed by ATF in the investigation" before Congress began pressing him for information about it in early 2011.
The Justice Department inspector general found no evidence that Atty. Gen. Eric Holder even knew about the operation that brought more than 2000 guns into Mexico. Fourteen federal law enforcement officials, however, are connected to the botched gun trafficking operation. NBC's Pete Williams reports.
The inspector general did determine that the acting deputy attorney general, Gary Grindler, received a briefing about the ill-fated gun-tracing operation in March 2010, but that the briefing "failed to alert Grindler to problems in the investigation."
The report also concluded that the operation was "seriously flawed and supervised irresponsibly" by federal officials in Arizona, who allowed it to continue in hopes of scoring a big case against a gun-trafficking organization despite obvious problems.
No one in Arizona, at ATF headquarters in Washington or at the Justice Department acted to end the operation until two weapons that were allowed to flow into Mexico were found at the scene of a shootout where a federal border agent, Brian Terry, was killed in December 2010.
"Fast and Furious" was an attempt to trace the flow of guns from the US into Mexico. ATF agents were instructed to allow suspected gun runners for the Mexican cartels to take guns into Mexico, because local ATF officials and local prosecutors believed they could then follow the weapons to the cartel higher-ups in Mexico. It didn't work that way, and roughly 2,000 guns were lost, most of them AK-47-type rifles, the report said.
Even after two of the trafficked guns showed up at the scene of Terry's death, senior ATF leaders did little to find out what went wrong. Instead, the report said, Kenneth Melson, then the acting ATF director, seemed more concern that agents were leaking information to the news media about the botched operation.
Holder, in a statement issued immediately after the report's release, said its "key conclusions are consistent with what I, and other Justice Department officials, have said for many months now," that senior Justice Department officials were unaware of the "flawed strategy and tactics" that dated back to the administration of George W. Bush and made no effort to "cover up information or mislead Congress about it."
Holder also announced that Melson, who was transferred out of the top job at the ATF last year, was retiring, effective immediately. A second Justice Department official, former Deputy Assistant Attorney General Jason Weinstein, has resigned. The report said Weinstein failed to tell Attorney General Holder about problems with the Fast and Furious operation.
In all, 14 current federal employees were singled out in the report for potential disciplinary action.
The report's publication seemed to do little to end the bitter rivalry between Holder and Rep. Darrel Issa, the California Republican who was among the first to question the Fast and Furious operation.
"It is unfortunate that some were so quick to make baseless accusations before they possessed the facts about these operations -- accusations that turned out to be without foundation and that have caused a great deal of unnecessary harm and confusion," Holder said in his statement.
"I hope today's report acts as a reminder of the dangers of adopting as fact unsubstantiated conclusions before an investigation of the circumstances is completed," he said.
In his own statement, Issa said, "Contrary to the denials of the attorney general and his political defenders in Congress, the investigation found that information in wiretap applications approved by senior Justice Department officials in Washington did contain red flags showing reckless tactics and faults Attorney General Eric Holder’s inner circle for their conduct.
"It’s time for President Obama to step in and provide accountability for officials at both the Department of Justice and ATF who failed to do their jobs," Issa said.
Politically charged partisan dispute
The operation has become a politically charged partisan dispute heading into the November elections, with congressional Republicans charging that the Obama administration has withheld documents that would show the involvement of senior government officials, including Holder.
On June 28, the Republican-led House of Representatives voted to hold Holder in contempt of Congress for failing to disclose internal Justice Department documents in response to a subpoena – the first time that sanction has been imposed on a sitting member of a president’s Cabinet.
The department’s inspector general spent more than a year investigating the so-called “gun-walking” scandal – in which agents of the federal Bureau of Alcohol, Tobacco, Firearms and Explosives, commonly known by the ATF acronym, in Arizona allow suspected gun runners to take guns into Mexico. The Fast and Furious operation was part of a broader initiative known as Project Gunrunner.
Local ATF officials and local prosecutors believed they could then follow the weapons to the cartel higher-ups in Mexico. It didn't work that way. Thousands of guns were lost and only lower-level straw buyers of the weapons were ever arrested.
Two of the weapons turned up at the scene of a shootout where a federal border agent, Brian Terry, was killed on Dec. 14, 2010, near the Mexico border, though those guns were never tied directly to his death.
A Mexican legislator, Humberto Benitez Trevino, claimed last year that weapons that crossed the border during the attempted sting have been linked to the deaths or wounding of at least 150 Mexican civilians, but did not provide any supporting documentation or say how that number was calculated.

Jo schmo agent isnt going to be shipping guns across the border on his own. Big cases like this are not given the blessing without top officials knowing including White House officials.
Actually, simply reading the memos that were sent to him would have given him plenty of knowledge. But, I guess it's ok in government work to not read the information delivered to you and say it was someone else's resposibility when the stuff hits the fan.
The question is when will he give up the documentation that has been sought by congress for months. The excuse before was that he couldn't because there was an ongoing investigation. Investigation finished. Stick a fork in the excuse, it's done.
But of course, the most open administration in history has declared "executive privilege" and said that they don't have to answer to congress anyway. Funny, how under Bush that was the most awful thing in the world but if it's Obama - hey, no problem.

What did you expect the report to say when it is being generated by employees of the agency whose head is being accused of incompetence. The report was never going to say Holder knew about the operation, even though atone with a brain would find it hard to believe that a joint operation of this magnitude would be conducted without his approval. Then of course you have the fact that the investigators did not have access to all documents regarding the operation because Obama has illegally applied executive privilege to them. This report is a politically driven farce that has absolutely no credibility.

Unfortunately, accountability at the highest levels seems to be missing across both government and private business these days.
That said, it seems clear Holder had no direct knowledge/involvment in this FUBAR'd operation. The question here is (and the same question should/could be asked across many banks/corporations): Should the "boss" be held accountable? In matters with such important ramifications, I would have to answer "yes".

It was not the Justice Department that found Holder blameless. It was the Inspector General of the Justice Department that produced the report. Inspectors General of any organization are supposed to be outside the normal chain of command within that organization and is supposed to be statutorily independent. At least in theory that's how it's supposed to work.
Obama needs to be voted out of office this November. Maybe then a real investigation into Fast & Furious can take place. For anyone to truly believe that the head of the Justice Dept. new nothing of this is BS. If the President had no knowledge of this why was executive privilege invoked? This is the absolute worse case of a cover up ever.

Independent, the justice department investigating itself and clearing itself is like Dick Cheney investigating himself and clearing himself of all wrong doing. Awwww, I'm flattered that you think I'm so popular but my Vineacity and small number of "friends" suggests otherwise. Also, my stance on the discrimination against gays and the war on drug users sort of sets me apart from conservatives. Not to mention the fact that I think we easily spend TWICE as much on our military as we need to. Not everyone who disagrees with liberals spending money like there is no tomorrow is a conservative. I don't condone anything Holder did with F&F, and most of the public believes that he was probably involved and knew. And even if he were put up on charges, the President would pardon him anyway.
My biggest problem with the man is that he is supposed to protect the rights of American citizens with his post, and then plays political games with "our" constitutional rights by stating that the President has the right to detain or kill American citizens whenever he chooses. Since when did we allow our representatives to be above the law?
We have NO rights without due process! It is impossible, because due process of law is what guarantees the rest.

President Obama used Executive Privilege not to give certain records to the congress. I believe that both Obama and Holder are guilty of obstructing justice. Chuck H - you really don't know how an inspector general works, do you ? An inspector general is independent of the department he/she works in. By law, all persons within the department must fully cooperate with an investigation or they can be terminated and charged with obstruction of justice or other crimes.
Most federal government agencies of sufficient size have an inspector general whose duty it is to make sure that the department carries out the duties according to the laws which created and under which the depart acts. Most also are charged with finding and preventing waste, fraud and corruption. The investigations of the Secret Service and the waste in the GSA were both done by inspectors general.

Why did it take almost two years to get to the bottom of this incident and why did the DOJ try to cover it up? Why did Obama invoke "executive privilege" during the Congressional investigation? There are a number of problems with this situation. First is that anyone with half a functioning brain HAS to know that unless the weapons have trackers in them (like the ones that the Bush administration used), once they cross the border, you have no control over them AND since the ATF was NOT cooperating with the Mexican government (unlike the Bush administration during the operation that they attempted.) the ATF has exactly ZERO authority south of the border. So what level of intelligence does it take to concoct an operation with absolutely ZERO chance of achieving the stated goal and then attempting to execute it OVER THE OBJECTIONS of the agents on the ground? How much brains does it take to say "Hey, wait a minute, we don't have the power to arrest anyone in Mexico, so if these guns cross the border, we can't get them back."? Oh wait the agents on the ground told their superiors that and were roundly told to STFU and get with the program or get out. One supervisor, when told that innocent people could be killed if the weapons were allowed out of the country said, "You can't make an omelet without cracking a few eggs." What an utter disregard for human life.
Even IF Holder had no knowledge of the operation, he is culpable for the outcome. That's part of the responsibility of being a leader. No one involved in this entire debacle has been penalized EXCEPT the agents who were the whistle blowers. All of the culpable supervisors have been transferred to other positions of the same pay grade or higher. Only the AZ US Attorney wasn't transferred. He resigned and promptly plead the 5th amendment to avoid self incrimination. THAT alone should tell you something. I honestly believe that had the owner of Lone Wolf Firearms not recorded the conversations between him and the ATF, he'd be facing the same legal nightmare that a family who owned (the feds are currently trying to seize all their assets) a gun shop in New Mexico is facing. They reported a suspicious gun purchaser to the ATF, and the ATF shut them down and arrested them for selling the guy a gun despite the purchaser passing the NICS check. Half of the family spent over a year in prison WITHOUT BAIL, HUGE Legal bills, and virtually all charges were dropped. Now the Feds are trying to use civil forfeiture laws to take everything else that they have.
The use of executive privilege in this case was not warranted. It is intended solely for communications between the oval office and his advisers, not inter office memos internal to the dept.
On the topic of IGs being independent of their agencies, tell that to the IG for the agency that found one of Obamao's supporters (a former NBA player) was cooking the books at the foundation that he was running on government grants. The IG was forced from the position and had his reputation ruined. BTW the grants kept right on rolling to that foundation.
A Federal agency (ATF) conjures up a plan to run 2000 automatic weapons into a sovereign country without their permission, It briefs the Deputy Attorney General but nobody thought they should clue in Holder and get his permission? Isn't he the boss? Isn't making legal decisions like this the reason he was appointed Attorney General by Obama? Shouldn't Obama have been consulted? Not any more than the Commanding General of the Army being made aware of an M.P. Major at Fort Bragg holding sting operations on prostitutes robbing servicemen on liberty. If the General ordered it yes, if the Major initiated it then he is responsible only to his chain of command and/or The base commander. That's how it works. DUH, and this is the program started under the last administration and carried forward. The Major at Fort Bragg might not even have thought to clue in the new Base Commander until a problem arose. The project had already been approve and was ongoing.
Whole agencies do not change in any way when an administration changes. Problems need to be brought to light then acted upon and in this case it apparently was.

Again Justice department investigating itself. After that Congress can sue the DOJ to force them to prosecute. I believe that case has been filed in federal court. The Gun Walking program did in fact start under President Bush. the very same field office in AZ was responsible for the loss of 12 guns in the Hernandez Case, and 450 guns in Operation Wide Receiver.

In Fast and Furious there was absolutely NO attempt made to track the thousands of weapons involved amd the operation was kept secret from the Mexican government.

I have read several comments that are blaming this on the Bush Administration. Where as the crack down for guns being sold and crossing the Mexican border actually did start under the Bush Administration, the original instructions were to stop them at the border and recover the guns and procecute the seller and the buyer. I find no mention under the Bush administration where they were to allow the guns to cross over to MEXICO. It was not until 2009 that they came up with letting the guns cross to see if they could track down the guns to the drug cartels. The agents were prevented from stopping the guns at the border by the higher ups over the program. Whether Holder and or Obama had anything to do with this or had any knowledge in my mind remains a mystery..We always want to know why Obama seals certain documents and keeps them from being viewed..What's that all about? Why would Mexico allow guns to come into their country willingly as they do not allow private citizens to own guns. Someone must have gotten a high level clearance in this matter and if they did not, than we should be seeing some people in high places spending time in PRISON as they have broken the laws of two countries.
