Officials say the FBI investigation into David Petraeus was triggered by a complaint from a family friend into emails sent by his biographer Paula Broadwell. NBC's Andrea Mitchell reports.
After investigating a potential case of "cyber-harassment" for several months, the FBI wrapped up its case after interviewing Paula Broadwell -- the biographer of former CIA director David Petraeus -- on Friday, Nov. 2, four days before the presidential election, a senior U.S. law enforcement official told NBC News.
It was the second time that FBI agents had questioned Broadwell in the probe and during both interviews she acknowledged having had an affair with Petraeus, the official said. Petraeus himself had been questioned a few days earlier and also acknowledged the affair, the first official said.
The dual interviews the week of Oct. 29 -- among the last to be conducted by the FBI in the case -- allowed the FBI to formally conclude there was no basis for criminal charges in the matter. This explains why the Director of National Intelligence James Clapper wasn't told about the probe until the following Tuesday, Nov. 6, election day, the official said.
The official offered new details about the FBI investigation -- and a more precise timeline of key events-- in order to rebut suggestions that senior law enforcement officials held back key information about the Petraeus matter until after the election.
The FBI and Justice Department's decisions on the case were not governed by the political calendar, the official asserted. Nor, the official said, were they influenced by a phone call from House Majority Leader Eric Cantor's office to the FBI on Oct. 31 asserting that it had heard from a FBI whistleblower who raised concerns that the Petraeus matter was being covered up or not being taken seriously.

"I was contacted by an FBI employee concerned that sensitive, classified information may have been compromised and made certain (FBI Director Robert) Mueller was aware of these serious allegations and the potential risk to our national security,” Cantor said in a statement.
According to reporting by NBC’s chief justice correspondent Pete Williams, a senior law enforcement official said a call to a congressional staffer came from an agent who was initially involved in the investigation but who was later removed from the case because he knew an associate of one of the people being investigated. The agent knew someone on the Hill and called that person, a Republican staffer, according to the official. But that phone call had no effect on either the course of the investigation, the involvement of Mueller -- who was following it closely long before Cantor called him -- or the decision to notify Clapper, the official says.
"This had nothing to do with the election," the official said. Moreover the official added, Cantor's office was told that the case was being actively investigated by the FBI when it raised the matter on Oct. 31, and so it would have been wrong for the FBI or Justice Department to inform higher level officials in the administration about the probe earlier -- because they were unsure at that point what they were dealing with. In the end, according to multiple officials, investigators determined there was no criminal wrongdoing.
The woman who complained of being harassed by Paula Broadwell, General David Petraeus' biographer, has been identified as Jill Kelley, 37, a senior official tells NBC News. NBC's Kristen Welker reports.
According to the senior official, the investigation began several months ago when a woman reported to the FBI she had received anonymous-- and harassing -- emails from a person she didn't know. Multiple government officials tell NBC News that the woman was Jill Kelley, who lives in Tampa, Florida. Kelley and her husband, officials say, are close friends of the Petraeus family. Kelley was a volunteer social liaison to the MacDill Air Force Base in Tampa.
The FBI viewed the matter as a potential case of "cyber-harassment" and it was handled "regionally" with federal prosecutors working with the FBI on the matter, the official said. At first, neither Kelley nor the FBI knew who was sending the harassing emails-- because they came from accounts that were not immediately identifiable. But the FBI was eventually able to determine they came from Broadwell and then obtained access to her regular email account. It was only then that the FBI discovered, through her email exchanges with Petraeus, an apparent relationship between the two of them, the official said.
The FBI continued investigating the matter and was close to wrapping up the case late in October, the official said. Agents finally interviewed Petraeus the week of Oct. 29 and then re-interviewed Broadwell, allowing them to complete their investigation, according to multiple officials. It was only at that point that the decision was made to pass along information about the case to Clapper, the senior law enforcement official said, setting in motion the chain of events that led to Petraeus' resignation.

This smelled funny from the beginning and the more we know the smellier it gets. Now we have the "victim" saying she was harassed by emails saying 'terrifying' things like "stay away from my guy" and instead of taking this to Petreaus to try to resolve, she goes directly to the FBI???
Then there's the whole situation where nothing even remotely illegal happened between Broadwell and Kelley, yet the FBI started digging through Broadwell's email, a private citizen's personal communications? That reeks of abuse of power.
Then there's the whole timing issue. Apparently the FBI knew of the affair almost immediately, in the summer of this year. At that point they would not have been investigating Broadwell anymore. They would have been investigating Petreaus. If this were true, then they would have been compelled to inform the congressional intelligence committees and the White House. The congressional committees were obviously not informed. Was the White House and if so what did the White House direct the FBI to do? Did the White House direct the FBI to illegally withhold that information from the intelligence committees? Again, why? If the FBI knew for months that he was having an affair why did they sit on the information all this time and it's only now that they confronted him about it? If they informed him earlier than that, then why for the past few days been lying about the timing and why did Petreaus suddenly feel compelled to immediately change course and resign, turning his back on those that served under him (completely out of character)?
In law enforcement there is a saying "If something doesn't seem right, then it probably isn't." Nothing about this seems right. It's stinking to high heaven.
I believe this may be tied to Benghazi. Look at the timeline.
The FBI is investigating the beginning, middle and end of Benghazi.
The FBI by accident found out about the affair in the summer. Ambassador Stevens started asking for help from the WH & the State Dept. during the summer.
I believe the FBI, while digging for facts about the beginning of the Benghazi fiasco, found the Petraeus' e-mails by accident. The FBI probably found damaging evidence against the WH & the State dept. and is using Petraeus' affair as a scapegoat.
There is no way the FBI would know about the affair and not inform the Justice dept., the Intelligence committee and the WH. No way. It has never worked this way. What is the FBI hiding? Did they find that Benghazi was a debacle from the very beginning? Who are they trying to protect? Are they trying to protect the Justice dept. & the WH? This itself is fishy.
One other thing, why are the journalists at media outlets like NBC, MSNBC, CNN, etc. not smart enough to ask the questions I posed in #1.9???

These are all things she clearly had access to via pillow talk. The General really screwed up...

The speculation yesterday on the Sunday news shows favored two conflicting theories. 1. Pres Obama wanted him gone - this prevented a fight. 2. Petraeus wanted to testify honestly, which he would have had trouble doing having this hidden - and working for people he may testify against.

It matters not whether he was a Republican or Democrat. He was the CIA director which is a BIG job. If he used his position in the CIA to carry on the affair, that is a problem. MUW, you're acting like she was the source of the story that a news organization (Fox) had already reported. Perhaps that's why she prefaced the statement by "You might have heard"...because the story was already out. Fox's story was from sources on the ground at the CIA annex in Benghazi and other sources in Washington confirmed this so she wasn't the source.

Can we perhaps get a few things straight, here?
First and foremost, can we stop with the Betrayus nonsense? I didn't approve of it when it was trotted out during the Bush administration and I don't approve of it now. The man has spent his life serving his country, and the best I can tell he did it quite well. There is not one of you can match his record, so leave that alone.
Second, as has already been pointed out, this doesn't stop him from being called to testify before Congress. Not no way, not no how.
Third, if Eric Kantor knew about this before the election and didn't go running to everyone who would listen to tell them, then you have one very politically savvy guy who concluded that this wouldn't help Republicans and wouldn't hurt the Obama campaign.
Fourth, why would it help Republicans and hurt Obama? If Eric Kantor had gone public before election day, what would he say? "I have information that the FBI is in the middle of an investigation of whether the D/CIA is having an extramarital affair. The Director of the FBI himself is monitoring it. It doesn't look like there's anything criminal going on, though." Not exactly an October surprise; in fact, it makes it look like government is doing its job -- well, except for Kantor, who is leaking non-public information turned up by the FBI that is very personally damaging to a number of people who have committed no crimes.
Fifth, if you are still talking about Benghazi, please, at least take a few moments to inform yourselves. CNN has a timeline of everything the administration has said about Benghazi from day one. There was no cover-up. Given the fact that the principal participants in the event from our side are dead, the administration's comments were prompt and accurate. The possible role of the movie trailer was mentioned in the earliest comments but so was the fact that it was an orchestrated terrorist attack. Also, the emerging timeline of the CIA and military response shows that there was no order to stand down anywhere. And if she were a true family friend, perhaps she wanted to only help?

This is great post. Why was this case even investigated if it is now considered not even a legal case? I mean seriously. The woman is a part time volunteer at Dill and a housewife.
My first response to the FBI is this. You obviously have too many men sitting around with nothing to do if you took on this case and worked it for months. I think we have found a great place for Paul Ryan and the republicans to go if they want to cut the budget because these guys have way too much time on their hands.
Second. I think we can cut the CIA budget as well. Pictures of Angie Jolie for Broadwell's Facebook wall sent by the good general. (That was in another article.) Reportedly hundreds if not thousands of X rated e-mails sent by the director of the agency. Seems like a lot of play time going on at Langley as well. And good to know we have special quarters for the fawning think tankers over that go over to Kabul. Wonder if the young men getting killed every day there are treated that well.

So what was Kelley being harassed about in the e-mail (which appears to have happened after the separation of Petraeus and Broadwell) that so far has not been mentioned in the news? Was there more to Kelley and Petraeus relationship, other than just friends??? Did Kelley have something to do with the ending of Petraeus and Broadwell's affair? Was Broadwell jealous about Kelley and why? It appears as if the agent jumped too soon when telling the Republican Congressman before the investigation was finished. Was he trying to stir up a problem with the election results, since the agent reported the incomplete case to a Republican Congressman in the House? I don't believe for one moment that the agent was removed from the case just because he knew an associate of one of the people being investigated. The whistle blowing agent started talking inappropriately outside the Agency office/rules without first following the Chain of Command within the Agency, and before all the facts were gathered. Again, what were the real motives for the agent reporting to a House Republican Congressman so early, esp. if it was later determined that there were no threats to the U.S. security, etc.? Since the situation was obviously not a threat, then why go to the Republican Congressman, other than to stir up some problems with the election results? Finally, no candidates are responsible for another man's inability to keep their pants zipped which is why the situation should not have had an effect on the election results, unless a Party were trying to create doubt in the voter's minds before all the facts were reported, or were involved themselves with one of the two in the past. There's more to this than what we have been told?

Once again I am ashamed of my fellow residents of my Congressional district for re-electing this POS. I certainly didn't vote for him and neither did my husband. We voted for his challenger. The Secretary of State, Hillary Clinton asked for reinforcements a week prior to the attack. This falls squarely on the shoulders of the POTUS. You are so right. Petraeus got caught because his crazy mistress was jealous about his friendship/relationship with another woman. Now, we understand that the emails were sent while the affair was going on. Kelley had no idea who was sending the emails therefore she notified the authorities. If she knew it was coming from Broadwell and Petraeus had an affair with her, she would have never contacted the authorities. She would have gone to Petraeus and he would have handled the matter. This whole thing was just unfortunate and because a man felt the need for a little adventure. He should have paid an escort, they are usually very discreet and have no jealousy.

I don't feel sorry for mistress #1 or 2---but the generals wife has my sympathies, as do any minor children involved in this unfolding soap opera. The mistresses of general patraeus deserve any and all misery headed their way. No good ever comes from an extra marital affair.

I don't know about worth it, however, I can say it's understandable if you simply put his wife and mistress side by side. This isn't meant to be mean. Just a statement of fact.
These military guys who make it to high ranks and rack up all kinds of accomplishments are a different breed. West Point graduate (top 5% of his class), Honors graduate of the Army Rangers School, PH.D. in International Relations, US commander of ISAF, Commander USFOR-A (US forces in Afghanistan), Commander USCENTCOM, Director of the CIA - just to mention a few. They don't get there because they are passive pussies. They are full of hubris, confidence, aggression and yes, testosterone. I'm not condoning the actions, just saying I understand them.
His wife I think was the daughter of the Dean at West Point, I have seen posts that said he married her for reasons other than love, who knows? Yes, she is not an attractive woman and Broadwell is younger and attractive. In one picture, I thought his wife was actually his mother but she doesn't deserve to be cheated on just being she is not attractive. He is not prize either, I think Broadwell was drawn to the power and his status.

He was already receiving a pension as a retired military officer. He may not be eligible for a federal government pension because he was not an employee for over 5 years...he may have been able to buy his military time, though.

If Cantor was informed it was probably at the direction of someone in the Administration. I noticed Cantor did not bring this up before the election, probably because he was told the facts and there was nothing to really yelp about in the way it was handled and the timing. If you want to show such righteous indignation about Libya, and yes that was a bad decision and tragedy to say the least, I will give you people and conspiracy theorists credence as soon as you start going after George Bush and Cheney for lying about the Iraq War and the reasons for getting in the war and killing thousands of our young men under false pretense. They really should have been brought up on charges for that...which is worse? lying to get us in a war or the President hiding a BJ from his wife and lying to keep his wife from finding out. There were weapons of mass destruction in Iraq after all.
The massive cache of almost 400,000 Iraq war documents released by the WikiLeaks Web site revealed that small amounts of chemical weapons were found in Iraq and continued to surface for years after the 2003 US invasion, Wired magazine reported.
The documents showed that US troops continued to find chemical weapons and labs for years after the invasion, including remnants of Saddam Hussein's chemical weapons arsenal -- most of which had been destroyed following the Gulf War.
In August 2004, American troops were able to buy containers from locals of what they thought was liquid sulfur mustard, a blister agent, the documents revealed. The chemicals were triple-sealed and taken to a secure site.
Also in 2004, troops discovered a chemical lab in a house in Fallujah during a battle with insurgents. A chemical cache was also found in the city.

Is there anyone out there, acquainted enough to comment on whether the FBI reports to the Executive Branch, or just reports to Congress when it feels like it? I would not think to have Congress involved with an FBI investigation, if for no other reason than it is more likely that Congress needs investigation. So exactly why an FBI agent should be calling House Majority Leader Eric Cantor, R-Va, is a complete mystery and then some?

In a country where more than half of spouses cheat and divorce each other, while lying in the process, this is a hypocritical response to this national hero whose affair had no impact on his job. Those whose lives are pure can criticize, but alas I am not perfect and do not care a twit. Both President Clinton and General Petraeus served their country diligently throughout their terms and should be judged on those criteria, not for a single personal error. I would expect we could fire most people from their jobs if based upon a single personal error.
Not everyone that is married cheats. It's not okay just because some do. Clinton was a disgrace to the office of the presidency and now, so is Petraeus, as a general. Can't believe a word that Clinton says.
I agree with everything you are saying Robert...but the reason Patraeus had to step down was for security reasons. It was written out that any affairs beyond the marriage bed for a CIA agent or operative was OFF LIMITS before this even happened. It puts that person in danger of being blackmailed. Another huge problem according to different sources was the fact that this women was given access to his personal email account at times. That could constitute a national security breach.
While I completely agree with you that personal affairs should be separated from business....when you take a job like the CIA you are held to a higher standard than other jobs and that is understood. He was not blindsided by these rules, nor is he the first CIA head to step down in the face of indiscretion.

You don't get to be a General without knowing - and living - HONORABLY. He didn't have any affair. He was told to 'take one for the team.' Had what he knows about not calling in help - and letting those soldiers be the 'sacrificial lambs' that they were - come out - and right before the election, people would be screaming for Obama's head. Impeachment at least. No. This way the General gets his two pensions and gets to 'fade away' like old soldiers do, with a nice life. His wife knows this is b.s., but they both know to go whistleblowing on Obama would have been the setting for a very miserable (if not very short) retirement, so there's my unyielding take on this whole mess.
