After ethics complaint, Sen. Menendez pays $58,500 for two flights to Dominican Republic

U.S. Sen. Robert Menendez this month wrote a $58,500 check to a company owned by a South Florida eye doctor and political fundraiser to reimburse him for two personal flights to the Dominican Republic that the New Jersey Democrat did not report on his Senate financial disclosure form, his office confirmed to NBC News Wednesday night. 


The disclosure came as law enforcement sources confirmed that FBI agents searched the West Palm Beach, Florida, offices of the doctor, Salomon Melgen, Tuesday night as part of an investigation that includes agents from the Department of Health and Human Services.

Melgen is a major Democratic political donor and fundraiser who together with family has contributed more than $200,000 to Democratic candidates, including $33,000 to Menendez. 

Menendez’s office confirmed that the senator — who this week became chairman of the Senate Foreign Relations Committee – wrote the check to Melgen from his personal account after aides reviewed his flight schedule in response to a complaint that a New Jersey Republican official filed with the Senate Ethics Committee last November. The complaint alleged that Menendez violated Senate Ethics rules by “repeatedly flying on a free jet to the Dominican Republic and other locations” and that the jet was provided by Melgen. 


“This was sloppy,” Dan O’Brien, Menendez’s chief of staff, told NBC News about Menendez’s failure to pay for the two 2010 flights at the time. “I’m chalking it up to an oversight.” Asked whether the senator has been contacted by the Senate Ethics Committee about the matter, O’Brien responded: “We can assume the Senate Ethics Committee is looking at the allegation. ”

O’Brien provided new details about Menendez’s relationship with the Florida doctor amid a swirl of media reports about the FBI probe. He said Menendez and the doctor have been longtime personal friends and that the senator has visited Melgen at his home in the Dominican Republican “about twice a year,” including attending Melgen’s daughter’s wedding. He said Menendez has generally flown commercial for those flights and paid for them out of his own pocket.

He confirmed that Melgen has also been an active fundraiser for Menendez, holding events for him at his home in South Florida as well as at a home he owns in Caso de Campo, a Dominican resort.

All told, the senator took three flights aboard Melgen’s jet in 2010 — one of which that May involved a trip to Puerto Rico and the Dominican Republican for political fundraisers, O’Brien said. One of those fundraisers was at Melgen’s home in the Dominican Republic, O’Brien said. The May 2010 flight for fundraisers on the two islands was paid for at the time by the Democratic Senatorial Campaign Committee, which Menendez then chaired. 

But after the ethics complaint was filed Nov. 3, his aides conducted what they described as an “exhaustive review of Menendez’s schedule” and found that the senator had taken two additional flights aboard Melgen’s corporate jet. One, from Aug. 6 to Aug. 9, 2010, was from south Florida to the Dominican Republic and back to south Florida. Another was from Sept. 3 to Sept. 6, 2010, was from Teterboro Airport in New Jersey to the Dominican Republican and back to New Jersey. In at least one of those flights, Menendez brought along guests, O’Brien said.

O’Brien said that after the review — spurred by the ethics complaint — Menendez wrote the $58,500 to Melgen’s company from his personal account. Under Senate ethics rules, senators are allowed to accept gifts from personal friends, but any valued at more than $250 must be publicly reported and approved by the Senate Ethics Committee.

In a statement earlier Wednesday, Menendez’s office said that: “Dr. Melgen has been a friend and political supporter of Senator Menendez for many years. Senator Menendez has traveled on Dr. Melgen’s plane on three occasions, all of which have been paid for and reported appropriately.”

That statement made no reference to Menendez paying for the trips in January, two months after the ethics committee complaint was filed. Asked about the omission, a spokeswoman for the senator said: “There was never any intention to be misleading.”

The spokeswoman said the senator was not aware of any time requirement for reimbursing for personal trips. She also said Menendez, by reimbursing for the flights, was not claiming the trips aboard Dr. Melgen’s plane was a personal gift. Although personal gifts above $250 need ethics committee approval, Menendez was not claiming the flights as a gift  and therefore does not need to seek approval of them from the committee, the spokeswoman said.

The delay for liberals posting is only because they are out gathering whatever they can on Republicans that have been caught in the past for ethical violations. You won't hear liberals saying anything about what a scumbag Menedez is or how he should be removed from Congress. What you will hear is how liberals are always willing to claim two wrongs make a right. Whenever anyone mentions the massive spending by Obama, the liberals response is that Bush started it. I can only agree with you to a point. I believe EVERYBODY in higher level politics is trying to COOL this one down. I'm thinking they are probably adhering to a teaching from Jesus about right now.....let them without sin cast the first stone. This story no doubt could be an avalanche with just a tiny bit more energy put into it. I know that in the Big Picture, our country is still very dicey and these things take away from trying to stave off disaster, BUT, it is exactly these kinds of things that ALLOW things to get so far out of hand that it's catastrophe. This stuff feeds on itself.

It needs to be broken. I think the easiest way is Term Limits.

Rangel or Waters do that, or did Democrats circle the wagons for them? How about Craig, Republicans openly pressured him to resign and although he refused he did not run for re-election. Democrats can't say that about both Waters or Rangel now can they? There are ethical issues on both sides of the isle, and none of them should still be in office. But none of the people you sight are still in office, and yet there are a whole slew of Democrats still serving with ethical violations. How long did it take for Democrats to finally pressure Anthony Wiener to resign? Want to bet he runs again and gets re-elected.       Florida and New Jersey are in a race to see which of our Politicians are the Biggest crooks. I admit that it is a tough hard fought race, but I do believe that My State, Florida is the Winner. We no doubt have the crookedest Politicians in the World. I think that it is funny that the State of Florida did not count in our last Presidential race. Obama was declared the winner before our State got its results in. I hope that everyone knows why Florida was late with the results. Florida Politicians were waiting to see if they had to cheat to get Romney elected, just as Florida Cheated to get BUSH elected. Well, by the time they decided to tally the Results, it was over. Angus(some of us have another word) King. be on the lookout for this crook,who claims to be an "independant"(made me switch to repub) but is a full dedicated democrat. this guy set up great tax "breaks" for wind power in Maine,while in office(back room) setting up a "wind company". after leaving office, petition the town of Roxbury to put up towers on their mountains,residents say no, require him to have the money to do the entire job with NO financing(shows proof of 250 million in liquid assets,that's cash folks),they approve, he then goes to congress and gets a "grant" to do the entire project(using OUR MONEY) AND doesn't use any of his money(and partners) at all. three days after Snowe announces she's had it with this congress and will not run again,he takes his name off every bit of the companies records,then announces he will run. i thought "there's no way they will elect this LYING SOB,but alas i was WRONG." when talking to a woman yesterday about it,she said " i had no idea he did that or i wouldn't have voted for him,i thought he was good as gov. years ago" moral of the story is people don't remember or investigate these politicians,so we get dung for representation. sorry guys,there's ANOTHER LYING POS HEADING FOR CONGRESS.

      Massachusetts just sent a proven liar to Washington to serve in the Senate, in speak with forked tongue Elizabeth Warren. She was corrupt long before she got there, and she filled the seat of a drunk that got a way with manslaughter at the very least. So it is hard to blame the politicians for being corrupt when the voters don't give it a second thought. For which Maine is another good example, as Angus King has never had a problem profiting from his time living off I mean serving taxpayers.

        Regardless of party, this is absolutely true. I stopped talking politics with friends and associates many years ago when I tired of hearing memorized talking points which were spewing from both parties. It became obvious that most voters don't understand the issues and can't even articulate a credible response when queried about their party loyalty. It is really bad.

            We need a 28th amendment which applies all laws and benefits equally with American people and all branches of federal government including all of the Executive, Legislative and Judicial branches.

            They would be on our Social Security not have the tricked up system they've voted themselves in. They would be on the same health care package as the rest of us. Their benefit packages could not be out of line with a normal private benefit package. Etc, etc.

            Watch how fast things get fixed then.

            I, personally am agog, shocked, and dismayed at the very notion that any Senator could be involved in any circumstance that even hints at impropriety. Regardless of their political party affiliation, a Senator represents not just their respective state, but the entire country. The august body of the United States Senate represents the very best of America, the quintessential nature of the Republic, the notion of nobility in government that rises above the pure party politics of the House of Representatives. A deliberative body where the good of the nation super cedes individual states or personages.

            Obviously, someone has made a grave error in even casting doubt on the reputation of any Senator. A Senator is by virtue of his or her lofty position above suspicion. If this is not the case, then the faith of the people in our government and it's integrity could be jeopardized. The Horror, the horror!

            Political corruption got really big after the Civil War, and has continued to the present. The idea of unlimited terms and increasing seniority in the Congress just for being re-elected (you don't even have to show up, as J. Jackson Jr. and Obama proved) is repugnant to me. They have a raise coming this year which seems odd when only 13% of Americans approve of their work product.

            LBJ worked well with a GOP Congress because he had dirt on almost all of them, and knew how and when to use it. Of course, you can't forget the grassroots...all those dead people in Texas and Chicago that voted Kennedy & LBJ into office.

            Hey Steve...I was a young wife and Mom to a 1 yr old baby girl when John Kennedy was shot to death in Dallas. So I'm sure there were things that I didn't understand intellectually about the ins and outs of politics. How so many of you can tell a good person from a bad one by knowing his/her political leaning. But I knew in my gut that John Kennedy wanted to lead this country to what it once was, then on to even greater strides. John Kennedy was an American in every sense of the word... including his womanizing. Americans are infamous for shredding their marriage vows, even the holy ones. And it crosses every line in our society, even politics. Oh...I do get on my soap box with the Holy Vows of Matrimony issue.

            Serving in Congress was never imagined to become a career by our founding fathers. But members learned how to stack the system for incumbents, and now buying politicians is how Washington works.             Nope that thing about being innocent until proven guilty is a myth...if the cops suspect someone they arrest them, place them in handcuffs and take them to jail...a case going to the grand jury is found to be true in almost every instance...when a person is charged and goes before the court they are in handcuffs attached to a body chain during the trial...the person stays in jail until and during the trial...all before a verdict by a jury...is this the way an innocent person is treated???

              Funny how the Senators name is not mentioned in the headlines because of the liberal controlled media. If this was a republican senator his name would have been splashed across the headlines along with a picture. And I bet that this story doesn't even make the news on the tri-state network channels. And also his trying to scramble the dates of his association with Bain Capital.

              Which is really not on topic with the article and has nothing to do with Senator Menendez. It just odd that so many here can not (would never) wonder why the Romney's were so uptight about reporting their financially dealings, but are so readily convinced that the Senator has participated in extreme activities without really having any idea what really went on.

              OMG...look at what I just wrote. It is a perfect example of the fundamental difference in the left and the right. Thank God the undecided Democrats and many Republicans saw through not only Mitt Romney, but the Tea Party as well. Now we must listen to these men try to rationalize for the powers that be why the entire electoral college set up should be changed. This move is for me absolute proof of the desperation the Tea Party Republicans have brought themselves to.

                What 'untold facts' would you like to know? I'm sure you know that there are millions of Americans who maintain offshore bank accounts for various reasons. There is nothing unethical, immoral, or illegal about maintaining an offshore bank account.

                Private flights/charter flights are more expensive per person than a commercial ticket. Total costs for the crew, plane, services, etc. are divided among the total number of passengers to determine the per person cost. As the story said, on one of the trips, there were other members of Menendez's party that he also paid for.

                  The Democrat political machine can get the vote even if they have to find ballot boxes in car trunks with all votes for a Democrat. Even if they have to pay them or vote multiple times or are not citizens or fixing the ballot machines. The main SEIU was broken up into little groups but they still are manipulating votes. Why don't Democrats want voter ID? Because they would lose close races. Democrats have had a long colorful history of voter manipulation, party machines, and corruption.

                    Prostitution isnt illegal everywhere. Not that im suggesting he used any. I personally dont care if he did. Just pointing out it isnt considered Taboo everywhere. Its even legal in some States.

                    These were underage prostitutes and the incident has been reported toauthorities in the Dom Rep.

                    Menendez should also be charged with tax eveasion for failure to report and pay taxes on the trips as they were gifts.

                    Do your legal homework dumbass, before you start spouting off about things you do not know! Although prostitution is legal in some countries and even some U.S. states, it is against FEDERAL law for any U.S. citizen or legal resident to engage in sexual relations with any minor or under age person, whether on U.S. soil or foreign soil. That means you can be prosecuted in the U.S. if you are caught having sex with a minor or practicing pedophilia in some other country and get caught. Of course, if it is a Democrat that is caught, they will either sweep it under the rug or wait until the closest election is over with before they say anything.
